Insight Social Publisher – Terms of Service

1. Identification & Purpose

These Terms of Service ("Terms") govern your access to and use of the Insight Social Publisher application ("Application"), operated and made available by Insight via the website domain (insight396.com).

Insight Social Publisher is a specialized publishing integration tool engineered to connect authorized social media creator accounts, including TikTok and YouTube, to draft, configure, schedule, and publish video content directly from the Insight platform using official platform APIs.

2. Acceptance of Terms

By connecting a TikTok or Google / YouTube account, authorizing access, or utilizing Insight Social Publisher in any manner, you expressly agree to be bound by these Terms and our accompanying Privacy Policy. If you do not agree with any provision of these Terms, you must not connect your account and must immediately cease using the Application.

3. Eligibility & Authorized Account Use

To use Insight Social Publisher, you represent and warrant that:

• You are of legal age to form a binding contract under applicable laws and meet the minimum age requirements mandated by TikTok.
• You are the rightful owner of the connected TikTok or Google / YouTube account or channel, or hold valid, explicit administrative authorization to connect it and post media on behalf of its owner.
• You possess authorized administrative access to the Insight platform.

4. Social Platform Account Authorization

When connecting via TikTok OAuth, you authorize Insight Social Publisher to interact with your account strictly within the scopes you explicitly approve on TikTok's consent screen (namely: user.info.basic and video.publish). This authorization is used solely to verify account identity, confirm connection status, and post content authorized directly by you.

When connecting Google / YouTube, Google OAuth uses https://www.googleapis.com/auth/youtube.upload to authorize publication of videos you approve to the YouTube channel that you own or are authorized to manage. You may revoke authorization at any time through Google Account permissions or, where available, the Insight disconnect control; revocation may disable automated publishing.

5. User Responsibility for Published Content

You remain solely and completely responsible for all materials, videos, audio tracks, text captions, descriptions, and hashtags published or scheduled through Insight Social Publisher. Insight does not pre-screen or endorse user content and assumes no legal liability for any materials published through your account.

6. Compliance with Platform Rules & Governing Law

You agree to strictly comply with all relevant third-party platform rules and applicable laws, including without limitation:

• TikTok Community Guidelines & Terms of Service: Ensuring that no published video violates TikTok's community safety policies, content standards, or commercial rules.
• TikTok Developer Policies: Refraining from any action designed to manipulate API quotas, bypass platform security, or distort platform engagement.
• YouTube Terms & Policies: You must comply with YouTube's Terms of Service, Community Guidelines, copyright requirements, and applicable platform policies when publishing to YouTube.
• Applicable Legal Standards: Upholding copyright, intellectual property, privacy, defamation, and consumer protection laws in all relevant jurisdictions.

7. Prohibited Uses & Misuse

You agree not to use Insight Social Publisher to:

• Upload or distribute content that infringes upon patents, trademarks, trade secrets, copyrights, or other proprietary rights of any third party.
• Publish harmful, abusive, defamatory, harassing, obscene, fraudulent, or hateful materials.
• Distribute unsolicited commercial messages (spam) or engage in deceptive engagement schemes.
• Attempt to probe, scan, or breach the security of the Application, the Insight platform, or TikTok's API infrastructure.
• Reverse-engineer, decompile, or extract the source code of the Application or exploit API endpoints outside of their intended administrative workflow.

8. Intellectual Property & Content Ownership

• Your Content: You retain complete ownership, copyright, and title to all media, videos, and texts you create and publish. Insight claims no ownership rights over your creative assets.
• Our Application: Insight (insight396.com) retains all rights, title, copyright, and intellectual property in Insight Social Publisher, including its software architecture, workflows, branding, and user interface.

9. Third-Party Services & Platform Availability

Insight Social Publisher interfaces with external platforms, including TikTok (operated by ByteDance Ltd.), Google, and YouTube. You acknowledge that third-party platforms are governed by their own independent service terms and technical infrastructures. Third-party platforms may update their APIs, introduce rate limitations, require periodic re-authorization, or impose service restrictions beyond our control.

10. No Guarantee of Platform Availability

Insight does not warrant or guarantee that TikTok, Google, YouTube, or their APIs will be continuously available, uninterrupted, timely, or error-free. Insight shall not be liable for any failed post delivery, upload delay, or processing rejection resulting from third-party downtime, API changes, or platform policy decisions.

11. Service Modification & Discontinuation

Insight reserves the right to modify, enhance, restrict, suspend, or discontinue Insight Social Publisher or any specific integration feature at any time, for maintenance, security, operational, or legal reasons, without prior liability.

12. Suspension & Termination of Access

Insight reserves the right to suspend or terminate access to Insight Social Publisher immediately and without prior notice in the event of suspected abuse, breach of these Terms, non-compliance with TikTok policies, or unauthorized system access.

13. Disclaimer of Warranties

Insight Social Publisher is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. Insight expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the Application will meet your requirements or operate without interruption.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Insight, its operators, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, or any action taken by TikTok against your account (including shadowbanning, suspensions, or content removals), arising out of or in connection with your use of or inability to use Insight Social Publisher.

15. Changes to These Terms

We may amend these Terms at our sole discretion. Updated terms become effective immediately upon posting to this URL with an updated "Last Updated" date. Continued use of Insight Social Publisher following the posting of changes constitutes full acceptance of the revised Terms.
